Unifor has postponed a certification vote at Toyota Motor Manufacturing Canada amid company claims that the union has underestimated the size of the proposed bargaining unit by about 1,000 workers. According to Jerry Dias, the union's president of organizing, the company submitted a list of 7,550 names it claims would be eligible to cast ballots as opposed to the union's estimate of about 6,500. "I was shocked," said Dias of the company's list. "This is a situation where one plus one isn't equalling two. "When production numbers drop, as they have the last couple years, you're not hiring a thousand people. "If the company keeps hiring and drags this out, in another year they'll employ everyone in the Cambridge and Waterloo community. It's wonderful because these are good jobs. The certification vote had been scheduled to begin Monday. Unifor has said it has signed membership cards from at least 40 per cent of hourly workers - the minimum required by the Ontario Labour Relations Board for a certification vote. But that is based on the 6,500 figure. "That's a significant difference in numbers," said Voy Stelmaszynski, a lawyer at the OLRB said. "It's a difference that means the union doesn't have the 40 per cent threshold. The union can challenge the company's assertion of the number of workers and job descriptions that would be part of a bargaining unit, said Stelmaszynski. Dias said the union will now go through the list of names to verify everyone would be part of the bargaining unit. He said the union had arrived at the 6,500 figure based on the company's previous numbers. Dias said Toyota previously claimed it employed 7,700 before hiring another 300 to 400 workers for their Lexus production. "Generally 15 to 20 per cent of those employees wouldn't be part of the bargaining unit, so that's about 6,500," Dias explained. The Japanese Automobile Manufacturers Association website, lists Toyota's total employment numbers at 7,400. That total includes 400 additional jobs stemming from the automaker's recent expansion at its Woodstock plant. With the vote delayed, Dias said the union will get back out its union cards and start trying to sign up more people to reach the 40 per cent minimum threshold. "There's no timetable to have a vote," Dias said. "We're going to ramp up and intensify the campaign. "My guess is the company will just keep on hiring. Lawson Crouse was the Kingston Frontenacs' first-round pick, fifth overall, in the 2013 Ontario Hockey League draft. Change text size for the storyPrintReport an error The Kingston Frontenacs are in an unusual position for Saturday's Ontario Hockey League Priority Selection. After eight years of selecting in the top 10 -- fifth last year and second in 2012 -- the Frontenacs, after an 84-point regular season, are down in the 15th selection spot. Not since Josh Brittain was Kingston's first-round choice in 2006 from the 14th overall spot will the Frontenacs be waiting that long to make their first pick at the draft table. General manager Doug Gilmour said it certainly makes for more of a guessing game for the Frontenacs. "We have three or four guys we like. Are they going to be there? We don't know," Gilmour said. The Sarnia Sting confirmed Friday that highly rated defenceman Jakob Chychrun was indeed their first overall selection. Other players who Kingston expects to be long gone by their selection spot include forwards Adam Mascherin, Michael McLeod, Brandon Saigeon, Jonathan Ang and Travis Barron. Besides Chychrun, some of the high-end defencemen mentioned are Logan Stanley, Reagan O'Grady, Victor Mete, Sean Allen and Sam Dunn. The Frontenacs, who will be hit hard on defence with Michael Moffat, Mikko Vainonen and probably Evan McEneny all gone, may be inclined to draft a defenceman first. "You have to look at what's needed but at the same time if there is a player available from a different position that's phenomenal, well, we are going to go after him," Gilmour said. "It's all projection. Our scouts have done another phenomenal job all year. The list is there for what we want, what we need. From there it is up to (assistant general manager Darren Keily) and I to do the rest. The draft does have the usual number of players who are projected high but have just recently made it known they are opting to follow the U.S. college route. Gilmour said those kind of cases, in which players could be trying to dictate what teams they prefer to go to, adds another element to selections. "It is so hard to evaluate. Like this little (Victor) Mete kid. He wasn't going to go to school, now he says he is going to school," Gilmour said about the Toronto Junior Canadiens player, a highly skilled offensive style defenceman. Gilmour said Mete is one of the fastest kids in the draft. "He's on our radar but all of a sudden he is not. He's going to school. Somebody got to him. Gilmour faced a similar case in 2011 when Max Domi was in the draft. He was also a player who warned off teams from selecting him. Gilmour wasn't deterred and selected Domi eighth overall. Domi didn't report and the Frontenacs received an an extra first-round pick in 2012 because of it. The player Kingston took was Sam Bennett. However, Gilmour said there will not be a repeat of that scenario Saturday. "We are not doing the Max Domi thing. There are other players there that we like. There are some forwards that we really like," Gilmour said. "Again it is the first year we have gone through this since I have been here. We are picking 15th not sixth, seventh, second or whatever. We are a different chart right now. After selecting 15th, the Frontenacs will pick 35th in the second round, have no third-round pick and come back in at the 71st selection in the fourth round. Regions U.S. China Europe Asia U.K. U.S. Israeli and Palestinian negotiators, joined by a U.S. team, plan to meet tomorrow to discuss whether both a will and a way exist to put Middle East peace talks back on track, according to an official familiar with the situation. The meeting’s outcome is likely to influence the Obama administration’s review of whether Secretary of State John Kerry continues his peacemaking efforts. The official discussing the session asked not to be named because the meeting is private. Kerry plans to consult with President Barack Obama on the status of his effort, as Israelis and Palestinians have sparred over who’s responsible for the latest impasse that quashed a deal to extend negotiations and free Palestinian prisoners. “Regrettably in the last few days both sides have taken steps that are not helpful,” Kerry said in Morocco yesterday before his flight back to the U.S. at the end of a regional tour. “There are limits to the amount of time and effort that the United States can spend if the parties themselves are unwilling to take constructive steps,” he said. “So it’s reality check time. It was the most pessimistic statement by Kerry, who landed back in Boston last night, since he brought the sides together last July for negotiations that were supposed to produce a peace accord this month. Instead, Israelis and Palestinians are caught up in increasingly acrimonious exchanges that threaten even Kerry’s scaled-down target of keeping the talks alive beyond the end of April. Israel on April 3 canceled the already postponed release of 26 Palestinian prisoners, saying it was a response to renewed efforts by Palestinians to gain recognition at the United Nations. Palestinian leaders said their move had been triggered by Israel’s failure to keep its promise over the prisoners. Other issues that divide the sides include demands by Palestinians for a freeze on settlement construction in the West Bank and east Jerusalem, and by Israel for recognition as a Jewish state. Saeb Erekat, the chief Palestinian negotiator, said at a conference in Ramallah yesterday that the negotiations aren’t dead and “if those prisoners are released, we can sit down with Israel and talk. Palestinian President Mahmoud Abbas this week announced his application to join 15 international treaties and conventions, in an effort to protest the stalemate in talks without incurring a cutoff in American aid. The U.S. has opposed the Palestinian bid for statehood at the United Nations, saying the issue is best addressed in talks with Israel, and Abbas agreed to put it on hold for the nine months that the Kerry-led negotiations were due to last. Kerry will confer with Obama and National Security Adviser Susan Rice on whether other matters such as the crisis with Russia over Ukraine should take a higher priority for him. “Both parties say they want to continue,” Kerry said yesterday of Israel and the Palestinians. “Neither party has said that they have called it off. Excessive pay for corporate CEOs is shaping up as a political issue at home and abroad. This week’s Question Period was marked by accusations of Harper government callous regard for hard-pressed middle-class Canadians by a tag team of Liberal Leader Justin Trudeau and NDP Leader Thomas Mulcair. There were echoes of the Occupy movement in the opposition leaders’ critiques of a government they say has presided blithely over a shift of society’s resources to the 1 per cent at the expense of the rest of us. To be sure, globalization plays a role in our income inequality crisis. But unwinding trade pacts and the Industrial Revolutions underway in the developing world are a practical impossibility. Which means if there is to be a battle over income inequality, it will be fought on the playing fields of Corporate Canada. CEOs make easy targets for politicians eager to be seen as populist champions. Last year, average total compensation for Canada’s 100 highest-paid corporate CEOs was $7.9 million. That’s 171 times more than the average pay of their workforces. (The U.S. figure is 354 times. In Britain it is 133 times. Fairness and common sense dictate that no man or woman is “worth” 171 times the value of those in the front lines, where the day-to-day work gets done. Nor is it explainable that in the 1980s, when Nortel Networks Corp. was pioneering the fibre optics that are the backbone of today’s Internet and Magna International Inc. was placing the bets that would make it the world’s third-largest auto-parts maker, the pay ratio was about 20 to 1. Have CEOs become 151 times smarter since then? Consider the tragedies of Lac Megantic and the oil-spill catastrophe wrought by BP PLC in the Gulf of Mexico, the implosion of Wall Street that triggered the Great Recession or the demise of Nortel through chronic incompetence and the answer is obvious. U.S. financier J. Pierpont Morgan and, much later, management guru Peter Drucker, each thought the pay ratio should be set at 20:1. CEO pay restraint was appropriate, said Drucker, since “So much of what we call management consists in making it difficult for people to work. Instead, the compensation rewards reaped by Canada’s business elite are way out of line. Canada’s economy grew by a substandard 1.7 per cent in 2013. Wages for everyday Canadians inched up by just 2.5 per cent. Our anemic export growth came in at 1.4 per cent. Canadian rates of industrial productivity growth remain among the worst in the industrialized world. And the average investor in Canadian stocks saw a modest 6 per cent gain in the S&P/TSX last year. Yet CEO pay growth outpaces all those leading indicators. For the top 100 highest-paid Canadian CEOs — who set the benchmark for all of Corporate Canada — 2013 average pay jumped by 52 per cent in what by most measures was a lousy year. Corporate pay routinely outpaces economic growth and corporate performance. Economics 101 tells us that this is unsustainable, except that the 1 per cent’s haul comes at the expense of everyone else. The European Union, the world’s biggest economy, will soon adopt measures requiring that the EU’s 10,000 publicly traded businesses reveal the pay ratio between CEOs and average workforce pay. The U.S. already requires that pay ratios be disclosed, as part of the Great Recession’s Dodd-Frank Act. Excessive CEO pay is a comparative anomaly in Germany, with its two-tiered structure of traditional and supervisory boards. The latter are made up of everyday shareholders and of directors elected by rank-and-file employees. In 2012, the supervisory board of Volkswagen A.G. imposed a 20 per cent pay cut on the CEO, despite record VW profits, feeling that his pay out of line with stagnant shop floor pay, and that his bonus targets were set too low — a trick that’s long been a mainstay of complaisant corporate remuneration committees. British reforms in corporate governance in 2013 give shareholders a binding vote on executive pay every three years. And the pay of the total workforce must be shown to influence how pay is set for top executives. The pro-business Conservative government headed by British Prime Minister David Cameron is irate over foot-dragging by Corporate Britain on those reforms. It is feeling the heat after recent disclosures of huge bonuses even at British companies whose profits have fallen or remain on government life support dating from taxpayer-funded bailouts during the Great Recession. Vince Cable, Cameron’s business secretary, told a gathering of British corporate CEOs in late March that “If companies and investors are unable or unwilling to act responsibly, the pressure for stronger measures will be hard to ignore. The pressure on politicians, that is. No amount of corporate lobbying will dissuade a government from action that will save its skin in a forthcoming election. Cable got specific about his intended corrective measures. They include punitive action against firms that fail to comply with the reforms, naturally, but also include the unprecedented step of requiring shareholders to disclose how they voted on executive pay. Will it come to that here? Conditions are ripe for it. Resentment is growing among financially struggling Canadians that a select few are getting much more than their fair share. Even the major institutional investors are restless over the disconnect between pay and performance. Members of the family that controls Rogers Communications Inc. enjoyed an 18 per cent gain in their net wealth in 2013, while ordinary Rogers shareholders eked out an 8.7 per cent gain in a year in which Rogers’ profits actually dropped slightly. If the U.S. president gets by with $400,000 (U.S.) in pay to run a $16-trillion economy, how is it that a crippled BlackBerry Inc. The Harper government delights in cost-free populist measures. A Cameron-style Fairness in Business package of corporate governance reforms would cost the federal treasury nothing and be mighty appealing as an election promise. It was sadly amusing to hear British shareholder advisory expert Sarah Wilson urging caution in forcing shareholders to vote on executive pay. “Voting is just one tool and sometimes it can be a blunt one. Sometimes a quiet conversation can achieve more. This is a bald fear of genuine shareholder democracy, of course. We value respectful and thoughtful discussion. The risks sound similar to banking crises — yet need different answers. Asset managers and banks are different beasts. Banks take credit risk on their balance sheet; managers leave risk with end investors. If management companies blow up, individual funds and investors may not be hurt. Even so, the way the industry is changing and growing creates risks. Passive investing through indexes or exchange-traded funds is mushrooming, and managers are growing bigger and burrowing deeper into less liquid investments. Haldane sees two key problems. One is size: the asset management sector, currently $87tn (€63tn), could reach $400tn globally by 2050. The bigger managers, funds or both get, the more an investor exodus or manager implosion could cause bank run-style dis-ruption. Asset manager blowups are usually one-off events — or may be isolated in single funds — but a future crisis may be systemic. The top 10 managers account for 30% of the sector, against 20% in banking. Second, asset management can have pro-cyclical effects through investor herding. Like banks that lend too much, asset management flows drive up asset prices to irrational levels, and cause exaggerated falls on the way down. Industry and investor short-termism, such as benchmarking and passive investing, and regulatory and accounting changes, all exacerbate herding. Unfortunately, Haldane is sceptical that this is just a matter of adding extra capital, as with banks. Making managers stronger may not protect their funds, or investors, or make markets safer. His suggestion of tackling liquidity weaknesses looks practical. That could be done by encouraging fund structures that lock in investors??? capital. One option, not mentioned by Haldane, is to let central banks act as a market maker of last resort to cushion manager runs, as the Federal Reserve did indirectly in 2008 to help US money market mutual funds, though that brings its own moral hazard risks. Harder still is tackling pro-cyclicality. One idea is simply to use monetary policy aggressively to tame animal spirits, by pushing up rates sooner. Haldane makes a case for the “first line” of defence, or macroprudential policy, yet he doesn’t specify how this would work. It’s not all doom and gloom. If managers of assets can be forced or prodded to be less short-termist, they can make the economy more resilient to shocks. When it comes to the too-big-to-fail discussion, there’s also the question of whether it’s the size of managers, individual funds, or a bit of both that presents systemic risks. Better for Haldane, other global regulators and the industry to think it through than to wait for an asset management crisis to find out. The volume of assets managed by asset managers may reach $400tn globally by 2050 from $87tn in 2013, based on current levels of economic and population growth, according to a speech by Andrew Haldane, executive director at the Bank of England. Haldane said the asset management industry had fundamentally changed shape over the last decade and would get larger still. He added that the assets it manages were increasingly being allocated into illiquid assets or indexed strategies. And the risks on these asset allocations were increasingly being borne by what he said were “perhaps trigger-happy” end-investors. Temporary People’s National Movement Senator Stuart Young has recommended the Elections and Boundaries Commission or the Integrity Commission be given the authority to audit campaign accounts of political parties. Young was speaking in the Senate on Wednesday on the private motion of Independent Senator Helen Drayton on campaign financing. He used the examples of Australia, Germany and France, where independent bodies did an audit of the accounts of either the candidates or the parties. In the case of France, the accounts are published “in a simplified form in the official gazette”, he noted. Noting financial disclosure was a critical ingredient of any election campaign legislation, Young said: “I envisage (that in the case of Trinidad and Tobago) it can be either the EBC or the Integrity Commission that would be granted the specific and the expressed powers to audit what has taken place after an election process with the amount of financing that has been gene­rated throughout that election process, and it starts with a mandatory disclosure poli­cy,” he said. He added the mandatory-disclosure poli­cy would require the person receiving the donation to disclose whom they received the donation from, the amount of the donation and the source of funds of that donation. “Because as responsible political parties, the question must be asked of people who are willing to donate substantial sums of money: where has this money come from?” Young added. Young said he was certain no political party in the country would want to fall prey to any money laundering or use of illicit money. “Certainly this side (the PNM) is ada­mant about it... One example that comes to mind... is now the subject of litigation, here a certain financier is alleged of his own evidence... to have given the sum of $60 million to a specific party as a contribution—as a loan, as he put it—for their campaign. Sixty million is a significant sum of money for anyone,” Young said. He said the sums being spent on elections within recent times were astronomical and there was a need for campaign finance legislation. “The time is right for it,” he said. Young also referred to the award of the contract for the Beetham wastewater treatment plant to Super Industrial Services (SIS). He also referred to SIS’s role in the financing of the Tobago Organisation of the People campaign in the Tobago House of Assembly election. “It was also alleged that he (an SIS official) was building houses... for Ashworth Jack... and then a palace down in Siparia,” he said. Government whip Ganga Singh said it had been refuted. Stuart said there must be a level of accountability and transparency because in this small country, it was very difficult for him to appreciate how even the most wealthy of the private sector could be in a position to contribute $10-, $20-, $30-, $40-, $50- and $60 million out of their own pocket to campaign financing, and I question all the time, where is that source of funding? Government Senator Gerry Hadeed countered that the PNM received $20 million for one company. Young also advocated each political party be given equal airtime on the State-owned media. “This is a way to balance the playing field, to level the playing field. It is something that should be adopted by the incumbent in allowing and putting in place mechanisms across the board, regardless of the party and regardless of whom a person is going to vote for, they are given an equal opportunity to get to the polling box,” Young stated. Young said he was pleased the Attorney General suggested the Government would be doing something about campaign-finance reform. “I wonder if they will be able to do something about it about the elections,” he said. Attorney General replied: “I want to reassure my learned friend that the Government intends to bring this legislation, and to introduce this bill in January 2016.” Young countered: “I welcome the Attorney Gene­ral’s declaration, and I am sure that he will pass the file over to the honourable Senator Al-Rawi in May 2015. Move on. Putting cool upgrades on the old Trop — and they're epic cool, don't get me wrong — will not necessarily make people go more often. It's as simple as that. Throw in the fact that some of you turds only show up to root against us (I'm looking at you, Cubs, Yankees and Sox transplants), and there's your answer. Bullying and badgering people to go only makes you look like an asshole, and getting all superior by bashing the area as not being a "sports town" makes you an even bigger, Lincoln Tunnel-sized asshole ... and wrong. I love my TV. And on a Wednesday work night after a Rays win, sometimes I prefer to hit the remote, fart and roll over for sleepy-time instead of wondering where the hell I parked. Sue me. Oh yeah, and there's another team in town currently splitting our attention (see paragraph #1). Honorable Afterthoughts: UConn, Wisconsin, Kentucky and your Florida Gators are the last remaining "final four" teams, if you will, in the 2014 NCAA Tournament (The SEC is down this year ... *cough*); The Florida State Seminoles appear to have changed their logo to a more "enhanced" head for next year (because after an undefeated championship season, it's time for a change); and finally, Kansas freshman wing Andrew Wiggins decided to leave early for the NBA draft. Division I runner-up features two of the region’s top players (Seamus Curran and Joe Mercadante) and a lefty-heavy rotation that is sure to give teams problems. First-year coach Brian Rheault has spent years in the program, so the transition should be smooth. Central- Led by Vanderbilt commit Isan Diaz (.435 batting average, .542 on-base percentage, .870 slugging percentage), the Golden Eagles have the experience and talent for a long run in the postseason. Mike Donato has created an atmosphere of success. Cathedral- Western Mass. Division I semifinalists, the Panthers are led by transfer Matt Cieboter, Pete Crinella and catcher Andrew Noonan. Look for Kevin Hassett to lead the Panthers on the mound. Westfield- Although the Bombers lost 10 seniors from last year's Western Mass. Division I championship team, Westfield still has a strong pitching staff anchored by Brent Houle and Matt Irzyk. If Chris Sullivan and Craig Lacey can carry the offensive production, the team should return to its winning ways. Amherst- Western Mass. Division I semifinalists, the Hurricanes are led by junior Jamie Carey (.400 batting average, 28 RBI), who is one of the top players in the region. Carey and Alec Snyder-Fair (33 strikeouts in 49 innings) will anchor a pitching staff that also features flamethrower Selah Dalomba. Greenfield- Pitcher Garrett Hudson (8-0 in the regular season, no earned runs in the Western Mass. Division II tournament) and leadoff hitter Jake Elwell (.553 on-base percentage) were two big reasons the Green Wave won the Western Mass. title in 2013. Look for centerfielder Drew Barisano to continue to produce (.370 batting average, 23 hits) as the Green Wave look to repeat. Frontier- The reigning Western Mass. Division III champions, Frontier looks to weather to graduation of three players key to their 2013 success. Look for ace Ben Ruddock to pitch deep into games, with complete games already the norm for the senior. Smith Academy- The runner-up in the 2013 Western Mass. Division III championship, the Falcons are led by standout pitcher David Longstreeth (132 strikeouts in 80.1 innings) and Keith Natale (36 hits, 23 RBI). In the duo, the Falcons have two studs on both sides of the ball, with Longstreeth and Natale putting up strong numbers offensively and on the mound. The Falcons look like the team to beat in Division IV. Ludlow- The Lions opened up the season with a 2-1 win against Westfield thanks to a strong complete game performance by Dimitry Bryant. This is a team that shows great patience at the plate, drawing six walks against the Bombers. Returners Kevin Boroweic, Alex Lafayette, and Zach Frangules combined for 64 hits and 46 RBI last year. East Longmeadow- The Spartans have much to prove after earning the No. 2 seed in last year's Western Mass. Division I tournament and losing to Westfield in the quarterfinals. Moving up to the Valley League will boost competitiveness. Returners John Bortolussi, Reed Phillips and Nate Anderson combined for 49 hits and 34 RBI last year. Caleb Berard is the staff ace (5-1, 42 Ks in 35 innings in 2013). Holyoke- Even with little time on the infield and pitching mound, the Purple Knights surged to two quick victories over Minnechaug (7-1) and Longmeadow (4-1). Senior shortstop Matt Wojnar figures to play a big part of Holyoke’s plans, defensively, offensively, and on the mound. Longmeadow- Always solid, the Lancers came out the gate with a comeback victory over Chicopee Comp, but fell to Holyoke 4-1. Nick Kennedy (10 strikeouts in 4 innings vs. Comp) and Connor McCarthy will need to continue their success on the mound for the Lancers to keep pace in the ultra-competitive Valley League. Northampton- One of the top Valley Wheel teams last year, the Blue Devils lost their top two run producers in Zack Goodwin-Boyd and David Konowitch. Senior Joe Warner comes back to anchor the pitching staff (5-3, 28 Ks in 53.2 innings in 2013). Southwick- Western Mass. Division II semifinalists in 2013, the Rams will be led by junior shortstop Vinnie Fortini. Fortini had 32 hits and 24 RBI to go along with a .390 batting average and .466 on-base percentage. Bob Hamel will lead Southwick on the mound. Chicopee Comp- Travis Seymour, Zane Kagan and Mike Bombard (combined 70 hits and 31 RBI in 2013) all return for the Colts, who started the season with a tough loss to Longmeadow. Bombard pitched a strong outing Thursday, throwing five shutout innings, while giving up only two hits and striking out eight. Palmer- Last year’s Western Mass. Division II semifinalists are led by an even stronger Tyler Wilson. The senior pitcher hurled a gem Thursday against Frontier, giving up only one hit and striking out 11 over five innings. Troy Remillard (24 hits, 12 RBI in 2013) returns as a formidable offensive threat. Monument Mountain- After going 15-5 in the regular season and earning the No. 1 seed in the Western Mass. Division II tournament, the Spartans lost to Southwick 11-5 in their first game of the tournament. Vassar-commit Bobby Kinne and pitcher/infielder Peter Oggiano should lead Monument to another strong season. Monson- A year after a 16-5 regular season record earned the Mustangs the No. 1 seed in the Western Mass. Division III tournament, Monson will be led by senior centerfielder Liam Christian, who had 34 hits en route to a .449 batting average with 16 stolen bases. Christian (33 strikeouts in 40 innings pitched) also figures to lead the pitching staff. Turners Falls- Senior catcher Brody Markol (.412 batting average on 28 hits, 17 runs) and junior pitcher Tyler Charboneau (3-1, 4 complete games, 22 strikeouts) will lead the Indians who lost 1-0 in the opening round of the Western Mass. Division III tournament in 2013. Pathfinder- The Pioneers will have to rely on the big bat of junior Austin LeClerc (two home runs, 24 RBI, 25 hits in 2013) to carry them through the season after losing four of their top run producers to graduation. Pathfinder lost to top-seeded Monson in the first round of the Western Mass. Division III tournament last season. Posted April 4, 2014 at 5:41 p.m. STEPHANIE HOOPS/THE STAR A vessel plugged into the Port of Hueneme’s new $13.6 million shoreside power system on Friday. The Port of Hueneme’s shore-side power system is up and running. On Friday, a vessel for the first time plugged into the new $13.6 million system on the docks, bringing cheers, smiles and handshakes from those on hand to see it power up. “Woo hoo,” exclaimed port CEO Kristin Decas, who proudly pulled the switch about 1 p.m. Decas said it was a big challenge that took two years and a lot of moving parts to secure funding for the project. “Today is a day of achievement for the port and for all the people who have been hard at work to see this thing through,” she said. The new system was built to comply with a new California Air Resources Board rule requiring ports to have land-based power systems to reduce pollution coming from container and cruise ships. The systems had to be in place by 2014. Vessels must plug in to power equipment at shore, allowing them to shut down diesel engines to keep from emitting nitrogen oxides and particulate matter into the air. The Port of Hueneme has three of its five deep-water berths available for vessels to plug in. Spokesman Will Berg said they are all operational. The Hamburg Sud shipping company vessel Cap Pasley was the first to receive power from the new system. The Cap Pasley stopped at the port to unload containers filled with several thousand tons of bananas. Giant red power cables were lowered from the ship via a cable reel to the shore power outlets located inside a vault. Technicians spent time connecting the heavy cables and locking pins and connectors to the outlets before activating the power at a nearby transfer station. Port administrators cobbled funds together from a number of sources, including $1.7 million in federal funds from the Ventura County Transportation Commission, $7.2 million of the port’s own money, $4.5 million from the California Air Resources Board and $250,000 from the Ventura County Air Pollution Control District. “It’s very exciting to have the first vessel plug in so quickly after we finished the project,” said Port Commission President Mary Anne Rooney. “We really appreciate all of the support we got from multiple avenues of financing. The Port of Los Angeles has 23 berths with shore-side power capacity, and ships have slowly and steadily been plugging in since 2004, according to spokesman Phillip Sanfield. Hillstone - American classics seem at home in S.F. Crab House on Pier 39 in S.F. Tarantino's a local staple on S.F. Scoma's - big, busy, S.F. S.F. How S.F. Those of us who live in the Bay Area are inevitably drawn to the waterfront, but don't necessarily head there for food. We tend to dismiss Fisherman's Wharf, eating there only with far-flung friends or relatives who have it at the top of their must-visit list. Other places along the shore do capture our attention, but then might blend into the mix. So last year, to commemorate the 150th anniversary of the Port of San Francisco, the Food & Wine staff decided to dive into what waterfront has to offer and visit every restaurant leased by the port commission, from Fisherman's Wharf in the north to Mission Bay in the south. That resulted in the ongoing Port Restaurants series that ends today. We came, we ate, we wrote - and we were surprised. We found that in general the newer high-profile restaurants like Hard Water and Coqueta warranted the crowds that fill them. We also found that some Fisherman's Wharf standbys fit squarely into our long-held negative stereotypes. Yet, others offered pleasant experiences that made us realize that there were some gems among the rhinestones. At the top of our list was Pier 39, which is definitely tourist central. However, in exploring all the nooks and crannies, we were impressed by the variety of offerings and the fact that only two of the restaurants - Bubba Gump Shrimp Co. and Hard Rock Cafe - are chains; the rest are locally owned, such as Mangos Taqueria & Cantina from the same family that travels in the El Tonayense taco truck. As frenetic as the pier gets, you can always find spots for snacking, people-watching and gazing at some of the best views in the city. The best food? No. But it's not just for "them" - it's part of the San Francisco cultural fabric. We've written volumes on the crown jewel of the waterfront, the Ferry Building Marketplace, which is a no-brainer both for dining and for provisions. You can stop in just about anyplace for great food to eat in or take home. Many things in our waterfront excursions made us reconsider our initial impressions going into it. One scam slipping past Indiegogo’s fraud algorithms might be carelessness. Two starts to look like complicity. For the past couple of weeks Pando has been reporting on Healbe — a near-$1m campaign on Indiegogo for a calorie counting watch that doctors and scientists say can’t possibly work. Despite countless red flags, Indiegogo has refused to suspend the campaign. Now Pando has learned that Healbe isn’t the first company to use Indiegogo to collect hundreds of thousands of dollars for an apparent medical miracle, only to be accused of misleading its backers. Less than six months ago, another company — Toronto-based TellSpec — closed a massive campaign but has already compromised many of its grand promises to revolutionize diet and nutrition, leaving Indiegogo users currently out of pocket to the tune of nearly $400,000. With that campaign, as with Healbe, Indiegogo has taken no action to protect its users. Founded by CEO Isabel Hoffman, whose big thing before this was anti-aging medicines, and CTO Stephen Watson, a York University math professor, TellSpec claimed to have created a small scanner that you could fit on a keychain and wave over your food to get live nutritional information about what you were eating. Physicists weighed in that the scientific claims made by Hoffman and Watson were at best dubious and at worst a blatant scam. According to TellSpec’s Indiegogo page, their food scanner would be powered by a “Raman spectrometer,” which puts out pulses of light to measure particle density and collect a detailed fingerprint of the food which is then analyzed in order to calculate nutritional information. Physicists called bull. Raman spectrometers are weak, big and expensive. To do this scan accurately you would need to be sending out a high density of wavelengths from the spectrometer, fueled by a high-powered source, not a tiny rechargeable battery as TellSpec claimed. It would be impossible, many people said, to miniaturize this so dramatically and to do so for a $250 price tag. That’s without taking into account that most experts suspected the technology would be useless in assessing the finer details of food texture and detecting small trace ingredients in low concentrations, like the food allergens it swore it could find. When pushed on how accurate the device could be and whether it could live up to the many medical applications it might have, TellSpec acted in almost exactly the same way as Healbe. The company walked back its performance claims, while not admitting that their science was bullshit. Which is a convenient way of saying, hey, we want your money, but not your FDA-related scrutiny. The weasel words used by both Healbe and TellSpec get to the heart of the real problem at Indiegogo: how exactly the crowd-funding platform defines “fraud.” Like Healbe, TellSpec is a real company that appears to have tried to make a physical thing. But on setting up their respective campaigns on Indiegogo neither appears to have been in any way honest about the medical claims it made for those physical things. The TellSpec campaign video features Watson and Hoffman waving the small device – which makes a classic “boop” sound when it scans, a lot like a barcode reader at an old school supermarket checkout – over a salad, a tostada, an apple and a chocolate truffle. Results flash up like magic inside a smartphone app, which the two founders discuss earnestly. “This tostada contains Tartrazine,” Watson declares, woodenly. “A food dye made from petroleum. In the UK and Europe there would be a warning on the package. Except it turned out the entire video was a fake. Bowing to pressure from online commenters who doubted that the scanner could work as described, TellSpec quietly added a disclaimer that ran over the first 25 seconds of the video. “The device shown in this video is a 3D model representing the future industrial design of the TellSpec scanner,” it reads. This is “not a working device” and is being used “solely for the purposes of demonstration. No such disclaimer is included in Healbe’s hastily put together demo video, apparently produced in response to mounting skepticism over whether their device existed at all. But, well, just look at it. Thanks to the disclaimer-free version of their video, TellSpec raised $386,392 on Indiegogo. Without the disclaimer Hoffman and Watson act with such seriousness and self-importance that you’d have no reason to doubt that this was the finished product right there in their hands. They clearly don’t want you to know they’re acting. At what point is a fake demo “fraud” according to Indiegogo’s definition. “TellSpec was first tested on a prototype with a large spectrometer, then we adapted it to the nanochip,” Watson tells the camera, near the end. “After nine months of hard work we are ready to move to the production of TellSpec,” Hoffman concurs, finishing his sentence. These are two magic sentences to hear if you’re a crowdfunder thinking about throwing some cash into the pot. But the problem is that the behavior displayed by TellSpec in the four months since this campaign closed at the end of November has exposed these words to be bald-faced lies. After the campaign closed, TellSpec’s actions have shown it has no idea how to make the device that it presented to Indiegogo as being ready to go on the basis of nine months of work and research. On November 18, TellSpec posted a “Live demonstration of technology” on its YouTube page. Unlike the small, less than palm sized device promised on Indiegogo, the scanner used in the four-minute video is much larger, doesn’t operate wirelessly and has a secondary part crudely taped onto it. Once again TellSpec displays its knack for misleading videos. When the camera focuses in on the phone to show off its analysis of the food being scanned, the phone’s clock is clearly on display. The first result is from 1:30 p.m., but in the next shot it’s 1:21 p.m., 1:22 p.m. and 1:23 p.m, before jumping back in time again to 1:15 p.m., 1:18 p.m. and 1:19 p.m. What we’re clearly seeing is not a live demo, but a series of cut together clips which cast doubt on whether what’s shown on screen has any connection to what was scanned by the device. On December 31 they posted a similar video, sans sloppy editing, which features Hoffman and Watson boasting at having refined their technology down somewhat, a full month after they’d banked nearly $400,000 for having claimed to have perfected it. In the following two months, no new videos were posted. Then surprise, surprise, in mid-March, TellSpec updated their Indiegogo page to say that they were ditching the technology that they claimed in the video to have spent nine months working on. The TellSpec scanner wouldn’t have a Raman spectrometer in it, but would instead feature Texas Instruments’ DLP technology, essentially a series of micro-mirrors that switch on and off at high speed. The new shipping date for supporters was pushed out from August to December. Some commenters greeted the news with enthusiasm, saying that the Raman spectrometer was too complicated to be miniaturized and still work. The majority of onlookers, however, remained as skeptical than ever. The thing that can’t be stressed enough here is that four months after closing a massive Indiegogo funding round for a product it claimed it could make, TellSpec had to reset the clock on its production. Four months after banking $386,392, Hoffman and Watson discovered that, as experts had been arguing from the start, the idea they had lied about having perfected wasn’t technically possible. Still, to Indiegogo this is all apparently just a natural risk of crowdfunding, as opposed to blatant fraud. I called TellSpec for comment. A bubbly sounding assistant picked up the phone. Hoffman and Watson weren’t in the office, she explained, but she was happy to answer my questions. Except, when I asked her about the change in production plans and the shift from Raman spectrometers to DLP technology and why it took four months to figure this out and how the company viewpoint had changed, from what it knew now to what it knew going in, she didn’t seem so keen. Hoffman and Watson were travelling to parts unspecified. Maybe I could talk to them, just not for a few days. She’d email me through some information. She eventually sent me through a link to the updates section of their Indiegogo page. Today we’re apparently seeing the same story play out with Healbe. As with TellSpec, Healbe’s campaign was dishonest from its inception: a Moscow company claiming to be from San Francisco, lying about its CES unveiling, so sure about its product until pushed on it, when all of a sudden it says that it is still working things out, talking up internal data and tests until people asked for them, when all of a sudden, the tests are now still underway. The only difference is that Healbe’s campaign is still underway, and there’s still a chance for Indiegogo — or one of their board members or investors, or anyone able to influence the company’s management — to do the right thing. Unfortunately, the more we learn about previous scams on the Indiegogo platform (and there are certainly more to emerge as we keep digging), the less likely it seems that they will. This new offer is nearly identical to one launched by T-Mobile a few months back. According to a new report, Samsung is working on a new Windows Phone-based smartphone. While the release date or cost has yet to be revealed, the phone is said to be in the midtier range. CiteeCar, a German ZipCar-like service that circumvents parking fees by letting some users have year-long free limited access to the cars in exchange for a parking spot, has raised $10 million. The company says that it already has a fleet of around 500 cars and that the program is going successfully. Egomotion, the company behind the Android app Agent, has raised $750,000 in a round it is dubbing a “second seed.” Google Ventures led the investment. Andrew Cuomo’s top aide tonight told the Journal News that those making $500,000 a year are merely “upper middle class” and those making $300,000 a year are “middle class.” In fact, the median household income in New York is $53,046 and in wealthy Westchester County it is $79,585. Note to self: Don’t mess with a Viking. That’s the harsh lesson we learned while watching the most brutal episode of “Vikings” yet. We’re not kidding. If you thought the battle between Rollo and Ragnar was gruesome, just wait until you see episode 6, “Unforgiven. The hit History Channel series began with Siggy paying a visit to Kattegat’s seer. According to Rollo’s lover, she’s still pretty upset over the fact that Ragnar killed her former husband, stripping her of her power. Siggy said she felt as if she’s been carrying around a stone of anger and bitterness. “Everything I was has been stripped away from me,” she confessed. “I want to know if the Gods will ever smile on me again. The seer assured her that the Gods would always smile on brave women. Looks like we can expect big things from Siggy from here on out. Episode 6 then cuts to a scene between King Horik and Ragnar. After returning home from Wessex, King Horik reveals what happened in England when Ragnar left to protect his family. “We were betrayed and taken by surprise,” King Horik said. “It was a great slaughter.” The King and his son barely made it out alive. Ragnar questioned what happened to Athelstan but no one seems to know. King Horik believes he was killed during the ambush and Floki couldn’t be more thrilled with his prediction. “We should rejoice of his death,” he quipped. Floki has never trusted the Pagan-wannabe. During King Horik’s homecoming feast, he explains to Ragnar that he wants revenge on King Ecbert. Rollo and Ragnar both agree. “We should return to Wessex. But first Jarl Borg must pay the price for what he did to our family,” Ragnar said. At that moment, a pretty slave girl spills water on Bjorn. She’s quite embarrassed but he thinks nothing of it. “We shall sail west. That was your dream, Ragnar, and I have come to share it. But we have neither the men nor the ships. I think we should go back to Jarl Borg. He’s licking his wounds. He’s not strong. Yet, we need him. We cannot go west without his ships. We should ask him to join our alliance,” Horik explained. Aslaug urges her husband not to listen to King Horik’s advice. But King Horik and Ragnar agree that Rollo should be the one to talk to Jarl Borg because he “knows him best. After the dinner party, Siggy joins King Horik and his son for a chat. Confused as to why the boy is there, King Horik says that he wants his son to witness the “game” they play. “Why do you invite me to your bed? Tell me things about Ragnar?” King Horik asks. Siggy replied that everything she does, she does for Rollo. “If Rollo rises, I rise also. Is she using him? Seems like it. After Siggy’s admission, King Horik reveals that he wants the brunette beauty to turn his son into a man. She toys with the idea but ultimately gives in and sleeps with the boy. Siggy isn’t the only facing issues with men. Lagertha also received a not-so-warm welcoming back home. “My wife has returned to me. That’s good,” the Earl said. “She went without my permission. I love her [for coming back]. Sigvard then raised a glass to Lagertha before admitting, “Unfortunately, you left my step-son behind. Lagertha explained that her son wanted to stay with his father. “He’s old enough to decide. Is it not enough I came back?” the shield maiden asked. “It’s not enough. It’s an insult to me,” that’s when Sigvard began mocking Ragnar. Lagertha didn’t look too pleased. The Earl wondered why his wife was defending her former lover. “You’re still in love with him. Aren’t you?” Earl Sigvard stumbled off in his drunken state, telling his wife she is to sleep alone tonight. That night Lagertha is brutally attacked by a handful of masked men. She is beaten unconsciously after attempting to defend herself. Unaware of his mother’s suffering, Bjorn is enjoying his time with his father—especially because the slave girl who previously spilt water on him has caught his eye. He walks up to her during her chores asking her personal questions from where she sleeps to if she has a boyfriend. “Of course,” she said. “I must finish my work. Ouch, Bjorn! But the young warrior refused to give up on the beautiful slave girl. Eventually, he invites her back to his home. He requests she sleeps in comfort instead of in the barn with animals. “This is your place. I cannot sleep here,” she replies. “I don’t want to order you. I want you to choose to stay here,” Bjorn says. That’s when the young woman starts stripping off her clothes. “Is this what you want master?” she asked. Ragnar had spotted his son initially flirting with the slave girl. As he looked upon the awkward incident, Aslaug begins firing questions regarding Horik. “Why do you let Horik decided everything? Do you really forgive Jarl Borg? Do you know how much I, how much your sons have suffered because of him? But you do nothing about it,” she complained. Rollo finally makes it to Gotland, Scandinavia where he meets with Jarl Borg to convince him to raid alongside Ragnar and King Horik. During their discussion, Borg puts the skull of his first wife on the table to “give him advice.” OK, so Borg is officially crazy. Rollo insists Ragnar isn’t looking for revenge and with that Jarl Borg decides to make another trip to Kattegat. While all this is going on, Athelstan is still alive and kicking. He’s become the unofficial right hand of King Ecbert due to his kindred spirit. King Ecbert reveals that he wants the teetering Pagan/Christian to help preserve the work of Romans, former Pagans. “Never speak of our conversation to any other man here. They would fear it. The fact is we have lost knowledge than we ever had. Pagan Gods allowed [Romans] to rule the world. And what is the lesson we can learn from that?” King Ecbert asked. He then threatened Athelstan that if he was to reveal to anyone what he was doing, that he would let the Christians crucify him. Ragnar and Jarl Borg finally reunite after their battle in Kattegat. “You are a greater man than I am,” Borg says. “I swear from hence forth you have no reason to doubt my commitment of loyalty. Ragnar admitted that he initially he wasn’t thrilled with the idea of teaming up with the man who threatened his family. But, then he thought of the things he could achieve with Borg's help. The most brutal scene of episode 6 followed Ragnar’s talk with Borg. After receiving a horrific beating, Lagertha was forced to appear at dinner with a swollen face. “What’s wrong my love?” Sigvard questioned. “You don’t talk, smile.” He aggressively grabbed her face and kissed her wounds. That’s when the drama started. “My wife has got the most beautiful breasts. I keep telling her but she doesn’t believe me,” he announced to the room filled with dinning guests. “Let me show you. Sigvard started ripping off Lagertha’s shirt but she quickly sprung into action grabbing a knife and stabbing her husband in the eye. He moaned in agony as everyone watched in awe. Someone picks up an axe and swings it. We thought he was going to attack Lagertha but the man ended up chopping off the Earl’s head, silencing his groans. After that, we hear Aslaug tell her boys a story. During the tale, several events happen. Rollo sets a barn filled with Borg’s men on fire while Ragnar’s warriors go and seek out the man who betrayed Ragnar. Borg wakes up—thanks to the whispering skull—and is armed when Rollo walks into his bedroom. Prior to Ragnar’s men entering, Borg hears the seer reiterating his prediction of the eagle. “I told you. I always look for revenge,” Rollo said to Borg. Ragnar’s brother watches upon comfortably in Borg’s bed as he’s beaten. King Horik wakes up due to all the ruckus and questions Ragnar what is going on. “I am sorry that the army of Kattegat has awoken you,” Ragnar replies. That’s when the drag a bloody Borg in. “Is he dead?” Horik asks. “He’s not dead.. yet,” Floki replied. King Horik asks why Ragnar has done this. “Do you really think I could ever forgive this man? April 4, 2014 | 2:30 p.m.His birth certificate said Birmingham, Ala., but the man who called himself Sun Ra declared that he was from the planet Saturn. Miles Davis set the late 1950s standard for jazz couture with his Italian tailored suits, but Ra wore Africanized capes, tunics and cartoonish headgear. After the big band era ended, he retained a respected core of musicians in his orchestra for decades — an achievement only duplicated by Duke Ellington. Though he operated on the fringes of the jazz world, Sun Ra (named for the Egyptian solar god) played his iconoclastic “space” music, and waited for his audience to catch up. With cacophonous collective improvisations and dissonant chords, the music always had solid underpinnings. One hundred years ago, pianist Herman ‘Sonny’ Blount began his odyssey, and the world has never been quite the same. Pasadena’s Allendale Branch Library observes the Sun Ra centenary Saturday with films and a freewheeling talk by a Ra expert. “I was fortunate to have seen Sun Ra’s Arkestra five different times,” said library assistant Terry Cannon. “His band played the entire spectrum of African American music: from Fletcher Henderson’s big band swing to the most cutting-edge avant garde. And he had this unique visual aspect to performance — colorful, sparkling robes and psychedelic light shows — that was unique to jazz. While commercial success beyond subsistence living eluded Ra for most of his life, he was an irresistible subject for independent filmmakers. Cannon will screen three Ra-themed movies: “Cry of Jazz” (1959), “The Magic Sun” (1968) and “Space is the Place” (1974). The late composer Ed Bland (1926-2013) produced “Cry of Jazz,” the first feature film on Ra. In 1993 he spoke on the occasion of a Los Angeles screening of the movie. He remembered the informal philosophical talks Ra gave in Chicago’s Washington Park — mixing ancient Egyptian references, pseudo Africana, and outer space fantasies. “His space talk,” recalled Bland, “didn’t interest me in the least. But his music did; I could tell that he was a well-grounded musician with knowledge of historical techniques. I’m a composer and I know when a musician knows what he’s doing. Bland was producing rock ‘n’ roll sessions, on which he used Ra and his musicians. “After a while,” said Bland, “he said he was tired of playing earth music and wanted to play space music.” Bland ultimately decided that Sun Ra wasn’t right for his rock dates but that he should be committed to film. “The movie caused quite an uproar: Willard Van Dyke of the Museum of Modern Art said it predicted the riots of the ’60s because it was the first time blacks challenged white authority in symbolic terms. Dr. Adilifu Nana, 45, is Associate Professor of African American Studies at Loyola Marymount University, and a self-described “science fiction film geek.” “Sun Ra was at the forefront of what I call Astro Blackness,” he said. “He flipped the American race narrative of slavery and apartheid to black space travel when the country was just beginning its space program. His cosmic persona challenged black folks and the status quo. He made ‘out there’ a compliment. The Arkestra (Ra’s play on “orchestra”) name continually changed, from the Solar Myth to the Astro Infinity to the Intergalactic Research to the Omniverse to the Altered Destiny 21st Century Arkestra. Even his most dedicated followers trailed far behind Ra, who never met an electronic keyboard he didn’t like. Sun Ra didn’t acknowledge his birth or believe in death. “He’s everywhere now,” Nama said emphatically. “You hear it in the music of Jenelle Monae; his image appears in one of her videos. And the electronic soundscape that Ra pioneered made possible Moby and Kraftwerk, to name just a couple. “He’s here now,” Nama added. “Sun Ra became that which he prophesized: this person who is everywhere at once but nowhere in particular. In a statement, the independent broker-dealer added that his resignation “was not related to company performance.” It plans to fill the post “from a slate of internal leaders” and anticipates “announcing this new leader by the end of next week. Bruton's exit from LPL’s San Diego operations comes just two days after it opened its new headquarters in the La Jolla district of the city. The news of his resignation was made public in an SEC document. A year ago, Bruton became LPL Financial’s representative on the Financial Services Institute’s board of directors. LPL Financial tapped him as a managing director in 2010. Before joining the IBD in 2007, he served as a senior manager at TD Ameritrade (AMTD), Merrill Lynch (BAC) and Charles Schwab (SCHW). He played a key role in the expansion of LPL's platform for RIAs. LPL Financial serves more than 13,600 independent financial advisors, 4,500 licensed insurance agents and some 700 financial institutions. It has a total of roughly 3,000 employees in San Diego, Boston and Charlotte. During a call with equity analysts in February, Chairman and CEO Mark Casady explained that the independent broker-dealer is no longer pursuing any plans to form a bank holding company. It is, however, still considering the possibility of acquiring an industrial loan company. Its stock, which fell 4% on Friday before the announcement of Bruton's exit, is up about 12% so far this year, way ahead of the major equity market indexes. This is where the comments go.
